How the contract is concluded
The User Agreement is a public offer within the meaning of article 437 of the Civil Code of the Russian Federation and an adhesion contract within the meaning of article 428 of the Civil Code of the Russian Federation. The contract is considered concluded from the moment you do any of the following (acceptance under clause 3 of article 438 of the Civil Code of the Russian Federation): register a user account, create an application, send a form on the website, or otherwise use the functions of the Platform.
Who the Platform is for
The Platform is intended for use in business activity: by legal entities and individual entrepreneurs, and by their authorized representatives. By registering, you confirm that you have reached the age of 18, have full legal capacity and act on behalf of the organization within your existing authority.
At registration, you give the INN of the organization or individual entrepreneur. The Operator checks it against the open data of the Unified State Register of Legal Entities (EGRUL) / of Individual Entrepreneurs (EGRIP) and confirms the user account after the check. Until confirmation, the functions of the Platform may be limited. The Operator may refuse to confirm the user account if the organization is not found in the register, is not active, or the data given is not reliable.
Applicable law and language
The law of the Russian Federation applies to the relations of the parties. The documents are written in Russian; if translations exist, the Russian version has priority.

User agreement
By using the Platform, you agree to these terms. If you do not agree with any provision, you should stop using the Service.
Terms
- Operator — individual entrepreneur K. S. Shalunova, company details are in the section of the same name; the person who provides access to the Platform and the personal data operator;
- User — a person who uses the Platform to prepare an application for conformity confirmation;
- Contractor — a certification body or testing laboratory with a valid accreditation certificate, whose data is in the Rosaccreditation register;
- Application — a set of data and documents about products, formed on the Platform;
- System suggestion — the result of automated processing: the expected HS code (TN VED), the list of technical regulations, the conformity assessment scheme and the set of documents.
What the Service does
The Platform acts as an information intermediary and provides information technology services: it helps to describe products, forms the System suggestion, collects a set of documents and passes the Application to the Contractor chosen by the User. The result of the Operator’s service is the prepared Application, not a document of conformity confirmation.
What the Service does not do
- does not test products and does not perform conformity assessment work;
- does not issue certificates of conformity and does not register declarations of conformity;
- is not a certification body, a testing laboratory, a customs representative or a customs clearance consultant;
- does not decide to accept the Application for work — this is the decision of the Contractor;
- does not give legal opinions and does not replace the advice of an accredited person.
User account
- a user account is created for access to the functions of the Platform; the data given at registration must be reliable and kept up to date;
- the User keeps the access credentials confidential on their own and is responsible for all actions made under their user account;
- any case of unauthorized access must be reported to the Operator immediately, using the contacts in the relevant section;
- transfer of the user account to third parties without the consent of the Operator is not allowed.
Duties of the User
- to give reliable and complete data about the products, their purpose, materials and characteristics, and about the organization;
- to check the System suggestion and the set of documents before sending the Application to the Contractor;
- to have the right to pass on the documents and data that are uploaded, including the consents of third parties, if such data contains their personal data;
- not to use the Platform to prepare documents for products whose circulation is restricted or prohibited;
- to comply with the requirements of technical regulation legislation when products are in circulation.
Prohibited actions
- interference with the work of the Platform, bypassing technical limits, attempts to get access to other people’s user accounts and data;
- automated data collection (scraping, parsing), creating a load that can disrupt the work of the Service;
- decompiling, copying and reproducing the software part of the Platform, except in cases directly allowed by law;
- uploading malicious code, and materials that violate the rights of third parties or the legislation of the Russian Federation;
- misleading Contractors about the properties of products.
Suspension of access
The Operator may suspend or end access to the Platform if this Agreement is violated, if there are signs that the data given is not reliable, and also at the request of authorized bodies. Where possible, the Operator informs the User of the reasons and gives time to remove the violation. Suspension of access does not release the User from obligations to the Contractor for Applications already accepted for work.
Availability of the Service
The Platform is provided “as is”. The Operator does not guarantee uninterrupted and error-free work of the Service, or compatibility with any equipment and software of the User. The Operator may carry out planned technical work and, where possible, informs about it in advance.
Cost and payment
Services of the Platform
Selection of the HS code (TN VED), technical regulations and the set of documents, and the creation of the first Application, are provided free of charge. The terms of the paid functions, their scope and cost are placed on the Platform and in the personal account before payment. Payment for the paid functions means agreement to these terms.
Services of Contractors
The cost of conformity assessment work, testing, and the preparation and registration of documents is set by the Contractor independently and is not set by the Operator. Payments for such work are made between the User and the Contractor under the contract concluded between them, unless the parties expressly agree otherwise.
Documents and VAT
The Operator applies a special tax regime; tax invoices are not issued and VAT is not charged, unless the invoice states otherwise. Closing documents are provided in electronic form to the email address given at registration.
Refund
Paid Platform services that have actually been provided are not refundable. If a paid function was not provided for reasons that depend on the Operator, the amount paid is returned to the same payment method within 10 working days from the receipt of the request.
Rights to materials
Materials of the Platform
The exclusive rights to the software of the Platform, interfaces, design, texts, graphics, databases and other elements belong to the Operator or are used by it on a lawful basis. The User is granted a simple (non-exclusive) revocable license to use the Platform for its functional purpose for the term of the user account. Other ways of use, including copying, modification and distribution of elements of the Platform, require the written consent of the Operator.
Materials of the User
The rights to the documents and data uploaded by the User remain with the User and the right holders. The User gives the Operator the right to use such materials only to the extent necessary to provide the services: storage, processing, forming the Application and passing it to the chosen Contractor.
Anonymized data
The Operator may use anonymized data, which does not allow a specific person or organization to be identified, to develop and train the algorithms of the Platform, and to produce statistics.
Personal data processing policy
The Policy sets the procedure for personal data processing and the security measures applied by the Operator. The document is published openly in accordance with part 2 of article 18.1 of Federal Law No. 152-FZ of 27.07.2006 “On Personal Data”.
Operator
OperatorИП Шалунова Ксения Сергеевна
INN631302187240
Person responsible for processingK. S. Shalunova
Categories of subjects and scope of data
- Users of the Platform — surname, first name, patronymic; email address; phone number; position and name of the organization; INN, OGRN/OGRNIP and address of the organization; open data of the Unified State Register of Legal Entities (EGRUL) / of Individual Entrepreneurs (EGRIP) about the organization or individual entrepreneur (full and short name, legal form, OGRN/OGRNIP, KPP, address, registration date, main type of activity, status, surname, first name, patronymic and position of the head); data about products; the content of requests, correspondence about the Application and messages to the AI assistant; uploaded files and photos; push token and device type; IP address and data about the platform of login (website, Android, iOS); when coming from the website — the Yandex Metrica visitor ID and the advertising click ID (see the “Cookie files” section);
- Representatives of Contractors — surname, first name, patronymic; contact data; position; accreditation certificate number and the accreditation scope of the organization;
- Website visitors — IP address, date and time of the request, data about the browser and device, source of the visit, actions in the interface, cookie identifiers.
The Operator does not process special categories of personal data (about racial and national origin, political views, religious beliefs, health, intimate life), biometric personal data, or data of minors.
Purposes of processing
- registration and maintenance of the user account, giving access to the Platform;
- forming the Application, selection of the HS code (TN VED), regulations and the set of documents;
- passing the Application to the Contractor chosen by the User after it has accepted the Application for work, and exchange of messages about it;
- informing about the status of the Application, answering requests, technical support;
- review of applications from organizations to connect to the Platform as Contractors;
- performance of duties under the contract and accounting;
- ensuring the security of the Platform and preventing unlawful actions;
- sending information and advertising messages — only with separate consent;
- improving the work of the Service on the basis of statistics and anonymized data.
Legal grounds
- consent of the personal data subject — clause 1 of part 1 of article 6 of Law No. 152-FZ;
- performance of a contract to which the subject is a party — clause 5 of part 1 of article 6;
- performance of the duties placed on the Operator by legislation (tax and accounting, storage of documents) — clause 2 of part 1 of article 6;
- exercise of the rights and legitimate interests of the Operator, provided that the rights of the subject are respected — clause 7 of part 1 of article 6.
Methods of processing and actions performed
Processing is carried out with the use of automation tools and without them. Actions performed: collection, recording, systematization, accumulation, storage, clarification (updating, changing), retrieval, use, transfer (provision, access), anonymization, blocking, deletion, destruction.
The Operator does not make decisions that create legal consequences for the subject solely on the basis of automated processing of personal data. The System suggestion is a recommendation and is confirmed by a person — see the “Limits of AI selection” section.
Data transfer
- the data of the Application, including the data of the applicant and the contact person, is passed to the Contractor chosen by the User after the Contractor has accepted the Application for work — to the extent necessary to perform the work; before acceptance, the Contractor sees only data about the products: name, HS code (TN VED), type of document, country of origin;
- data may be processed on behalf of the Operator by engaged persons: the hosting and infrastructure provider, the email sending service, the web analytics system. Contracts are concluded with such persons that require them to keep confidentiality and to comply with the requirements of Law No. 152-FZ;
- to check the registration data of an organization or individual entrepreneur, the INN given at registration is passed to the “DaData” service (LLC “Data Kyu”, INN 7721581040, personal data operator, processing in the territory of the Russian Federation), which returns the open data of the Unified State Register of Legal Entities (EGRUL) / of Individual Entrepreneurs (EGRIP); for address hints when an address is entered and to find its coordinates, the entered address text or the coordinates of the point chosen on the map are passed to the same service; other data of the User is not passed to this service;
- for the work of the AI assistant (the dialogue when the Application is created, selection of technical regulations), the text of the messages that the User enters in the dialogue with the assistant, the name of the products and the country of production are passed to the generative model service Yandex AI Studio (a Yandex Cloud platform, LLC “Yandex.Cloud”, processing in the territory of the Russian Federation); storage of these requests by the service and their use to improve the service are switched off; the dialogue history needed for the assistant’s answer is stored on the side of the Operator;
- the map used to choose an address and a pickup point is built from the OpenStreetMap map data (© OpenStreetMap contributors, © OpenMapTiles), which the Operator receives from the OpenFreeMap service through its own server: the device of the User contacts only the server of the Operator, and the IP address and device data of the User are not passed to this service;
- if the address is not found in the “DaData” service (usually the address of a production site outside Russia and the CIS countries) or the service is temporarily not available, the Operator passes from its own server the entered address text or the coordinates of the point to the address search service Photon (komoot GmbH, Germany) — without data that allows the User to be identified: without the name, contacts, company details and IP address of the User;
- if the User orders delivery of samples through the Platform, the CDEK delivery service (LLC “CDEK-Global”, processing in the territory of the Russian Federation) receives the name of the organization, the name and phone number of the sender’s contact person and the cargo pickup address — to make the waybill and call a courier; other data of the User is not passed;
- data is given to other persons only in cases provided for by the legislation of the Russian Federation — on reasoned requests of authorized bodies;
- the Operator does not carry out cross-border transfer of personal data, except for the transfer of the push token and the app installation ID, technical data about the device (model, version of the operating system and of the app), the notification title and the application number to the notification delivery services of the mobile app (see the “Push notifications in the mobile app” section). Such transfer is made in compliance with article 12 of Law No. 152-FZ, including notification of the authorized body.
Place of processing and storage
Databases that contain personal data of citizens of the Russian Federation are located on servers in the territory of the Russian Federation. This complies with part 5 of article 18 of Law No. 152-FZ.
Processing periods
- user account data — for the period while the account is valid; after a deletion request — up to 30 days (see the section “Account deletion”), unless the law sets a different period;
- data of Applications and related documents, including uploaded files, final documents and drafts — for the period while the user account is valid; after a deletion request — up to 30 days (see the section “Account deletion”);
- unsent drafts of Applications and the files uploaded to them — 90 days from the last change, after which they are deleted automatically;
- data of a registration that did not pass the Operator’s check, including files uploaded during registration — 30 days from the date of refusal, after which they are deleted automatically; during this period you may dispute the refusal by writing to the Operator;
- contracts and invoices issued by the Operator (primary accounting documents) and anonymized information about the order and payment — 5 years after the end of the year in which they were prepared (article 29 of Federal Law No. 402-FZ “On Accounting”, sub-clause 8 of clause 1 of article 23 of the Tax Code of the Russian Federation), after which they are deleted automatically;
- data of requests — 3 years from the date of the last message;
- correspondence with the AI assistant — up to 180 days;
- data for advertising mailings — until the consent is withdrawn;
- cookie data — according to the periods stated in the section “Cookies”;
- security log (email address, IP address, type of event — login, code request, password change) — 90 days; records of a deletion request and of the deletion of a user account — 3 years, as confirmation that the data was destroyed; log of actions of the Operator’s employees in the administration panel — 3 years;
- database backups — no more than 30 days, after which they are deleted automatically; deleted data may remain in backups until this period ends and is used only for recovery after a failure.
When the purposes of processing are reached, or when consent is withdrawn, the data is destroyed or anonymized within a period of no more than 30 days, unless the law provides otherwise. The destruction is confirmed by a completion certificate.
Security measures
In accordance with articles 18.1 and 19 of Law No. 152-FZ, the Operator applies:
- appointment of a person responsible for organizing the processing of personal data;
- issue of local acts on the procedure for processing and on protection measures, and familiarization with them of persons who have access to the data;
- identification of security threats and use of organizational and technical measures: separation of access rights by role, password policy, storage of passwords as hashes, encryption of the transmission channel (TLS), logging of actions;
- backup (copies are stored no more than 30 days) and control of data recovery;
- accounting of storage media and control of access to premises;
- internal control of compliance of processing with the requirements of the law;
- assessment of the harm that may be caused to data subjects in case of a violation.
If an unlawful transfer of personal data is detected, the Operator notifies the authorized body within the periods set by part 3.1 of article 21 of Law No. 152-FZ: within 24 hours — about the fact of the incident, within 72 hours — about the results of the internal investigation.
Push notifications in the mobile app
To deliver notifications about the progress of an application, the mobile app uses the Firebase Cloud Messaging service of Google LLC (on Android and iOS), and on iOS devices also the Apple Push Notification service of Apple Inc. The following is sent to these services: a technical device identifier (push token), the app installation identifier and technical information about the device (model, version of the operating system and of the app), the title of the notification (for example, “Document ready”) and the application number. The text of the application, amounts and documents are not sent through them. The push token is stored by the Operator together with the device type (Android or iOS) until you log out of the user account on this device or the user account is deleted. You can turn off notifications in the settings of the operating system; emails are still sent to your email address.
Rights of the personal data subject
You may:
- receive information about the processing of your data, as provided by part 7 of article 14 of Law No. 152-FZ: confirmation of the fact of processing, its purposes and methods, the composition of the data, the sources, the periods, and information about the persons to whom the data is transferred;
- demand that the data be corrected, blocked or destroyed if it is incomplete, outdated, inaccurate, obtained unlawfully or not necessary for the stated purpose;
- withdraw consent to processing;
- object to receiving advertising messages;
- appeal against the actions of the Operator to Roskomnadzor or in court.
How to send a request
The request is sent to iigalochka@yandex.ru or by post to the address in the section “Company details”. The request must contain the number of the main identity document of the data subject or of the representative, information that confirms the participation of the data subject in relations with the Operator (for example, the email address of the user account) or information that otherwise confirms the fact of processing, and the signature of the data subject or the representative. The representative attaches a document that confirms the representative’s authority.
Response periods
- information about processing is provided within 10 working days from the date the request is received; the period may be extended by no more than 5 working days, with a notice of the reasons;
- if an inaccuracy is found, the data is corrected within 7 working days, and processing is blocked for the period of the check;
- in case of unlawful processing, it is stopped within 3 working days, and the data is destroyed within 10 working days;
- when consent is withdrawn, processing is stopped and the data is destroyed within 30 days, unless the Operator has another legal basis for processing.
Withdrawal of consent that is necessary to provide the services makes it impossible to continue using the Platform. Data whose storage period is set by law (accounting and primary documents) is kept until this period ends.
Account deletion
You can delete the user account of the personal account in two ways:
- in the mobile app or in the account: “Profile” → “Delete account” → confirm;
- by email from the address of the user account to iigalochka@yandex.ru with the subject “Account deletion”.
After the request, access to the personal account on all devices stops. Within 30 days, the following are deleted: the user account, profile data, manufacturers and products, Applications, uploaded files, documents for Applications (including final documents and drafts), and correspondence on Applications and with the AI assistant. Of the data on Applications, only these are kept: contracts and invoices issued by the Operator (primary accounting documents) and anonymized information about the order and payment. They are kept for 5 years after the end of the year in which they were prepared (article 29 of Federal Law No. 402-FZ “On Accounting”, sub-clause 8 of clause 1 of article 23 of the Tax Code of the Russian Federation), after which they are deleted automatically. In addition, unsent drafts of Applications and the files uploaded to them are deleted automatically after 90 days without changes. Security log records are kept for the periods stated in the section “Processing periods”, including the record of the deletion itself — 3 years.
The User receives the final conformity document in the personal account and can download it before sending a request to delete the user account. Information about issued certificates and registered declarations of conformity is contained in the Rosaccreditation register, and information about state registration certificates is in the register of the Eurasian Economic Commission.
Data of third parties in application documents
The documents uploaded by the User may contain personal data of third parties — employees, managers and contact persons of counterparties. For this data, the User is the operator that determines the purposes of processing, and the Operator of the Platform processes it on the instruction of the User, in accordance with part 3 of article 6 of Law No. 152-FZ.
Processing instruction
- processing is carried out only for the purposes of creating the Application and passing it to the selected Contractor after the Application is accepted for work;
- list of actions: collection, recording, storage, retrieval, use, transfer to the Contractor, deletion, destruction;
- the Operator undertakes to keep the data confidential, to apply the measures provided by article 19 of Law No. 152-FZ, and not to disclose the data to third parties without the User’s instruction, except in cases set by law;
- the Operator is not required to obtain the consent of the subjects of this data: this obligation lies with the User as the operator.
User’s guarantees
By uploading documents, the User confirms that the User has a lawful basis to transfer the personal data contained in them, including the consent of the data subjects, if it is required, and that the amount of data transferred does not exceed what is necessary to prepare the Application. The User is solely responsible for the lawfulness of the transfer of this data.
Consent texts
Consent to the processing of personal data
By ticking the relevant box, or by sending the form or registering, I give individual entrepreneur Ksenia Sergeevna Shalunova (INN 631302187240) my consent to the processing of my personal data: surname, first name, patronymic, email address, telephone number, position, name and details of the organization, and the information that I state in the Application and in my requests. The processing is carried out for the purposes of registration on the Platform, creation of the Application and passing it to the selected Contractor after the Application is accepted for work, information about the status of the Application, replies to requests and performance of the contract. The list of actions with the data and the methods of processing are stated in the Personal Data Processing Policy. The consent is valid until it is withdrawn. It can be withdrawn by sending a request to iigalochka@yandex.ru.
Consent to receive advertising and information messages
By ticking the relevant box, I consent to receive information and advertising messages from individual entrepreneur K. S. Shalunova by email, in messengers and by telephone, in accordance with article 18 of Federal Law No. 38-FZ of 13.03.2006 “On Advertising”. The consent is voluntary, is not required to provide the services, and may be withdrawn at any time — by the unsubscribe link in the email or by a request to iigalochka@yandex.ru.
Refusal of advertising messages does not affect the receipt of service notifications about the status of the Application and the operation of the user account.
Cookies
Cookies are small text files that are saved in the browser when you visit a site. We use them for the following purposes:
Technicalkeeping you logged in to the personal account (session key in the browser’s local storage), session protection, saving interface settings. Period — until you log out of the account; settings — up to 12 months
Analyticalassessment of how convenient the service is, visit statistics in anonymized form. Period — up to 24 months
Functionalremembering the values you chose in the application form. Period — up to 30 days
Technical cookies and the browser’s local storage are necessary for the Platform to work: without them you cannot log in to the personal account. Analytical and functional cookies are used on the basis of your consent and can be turned off in the browser settings. You can refuse analytical cookies with the “Decline” button in the cookie notice. After that, the Yandex Metrica counter is not loaded on the site, and the cookies that it has set are deleted.
To collect anonymized statistics, the web analytics system Yandex Metrica is used; its operator acts as a person that processes data on the instruction of the Operator. In addition to the visit counter, Metrica has the following turned on: recording of actions on the page (Webvisor), click map and tracking of link clicks. This means that movements of the pointer, clicks, scrolling and the sequence of viewed pages are recorded. The content of input fields is not sent in the recordings.
If you came to the account from the site, then at registration the Yandex Metrica visitor number and the advertising click number are saved together with the user account (pseudonymized identifiers: without Yandex’s data, they cannot be used to identify a person). Through them, only the fact of registration is sent to Yandex Metrica — without email, telephone and other account data — to assess the effectiveness of advertising.
You can manage the set of cookies with browser tools — by deleting saved files or by forbidding them to be set. You can refuse the collection of data by Metrica by installing a Yandex Metrica blocker. If you turn off technical cookies, some functions of the Platform will not be available.
Rules for the use of recommendation technologies
This document is published in accordance with article 10.2-2 of Federal Law No. 149-FZ of 27.07.2006 “On Information, Information Technologies and Information Protection”. The Platform uses recommendation technologies — algorithms for providing information based on data about the preferences and actions of the user.
Where they are used
- selection of the proposed HS code (TN VED) and applicable technical regulations from the description of the product;
- creation of the set of documents for the selected conformity assessment scheme;
- selection of Contractors whose accreditation scope covers the requirements of your Application.
What data is used
- information that you enter: name, purpose, materials and characteristics of the product, answers to the assistant’s questions;
- information about Applications that you prepared earlier within your user account;
- reference data: lists of products, texts of technical regulations TR CU and TR EAEU, the HS code (TN VED) classifier, information from the Rosaccreditation register;
- anonymized technical data about the operation of the interface.
Special categories of personal data, biometric data and information about correspondence are not used in recommendation technologies.
How the result is created
The algorithm compares the description of the product with the features of product items and with the areas covered by technical regulations. Then it ranks the options by the degree of match. Contractors are selected by formal criteria: valid status of the accreditation certificate, match of the accreditation scope to the subject of the Application, and readiness to accept applications. The ranking of Contractors does not depend on payment: no priority in the results is given for payment.
Your control
- The System suggestion is shown with a justification and can be changed by you manually before the Application is sent;
- you may choose any Contractor from the available ones, not only the one suggested first;
- you may refuse the use of recommendation technologies by sending a request to iigalochka@yandex.ru; in this case, the selection is made without taking into account data about your previous Applications, and work with the classifier and the regulations is done in reference mode.
Requests on the use of recommendation technologies are sent to the stated address; the answer is provided within 10 working days.
Limits of AI selection
The HS code (TN VED), the list of technical regulations, the conformity assessment scheme and the set of documents suggested by the system are for information and recommendation only. They are not a classification decision, an expert opinion, an advance ruling on the classification of goods, or any other document that has legal force.
- suggestions are created from the description of the product provided by the User: an incomplete or inaccurate description leads to an inaccurate result;
- the System suggestion is shown with a justification, is open to checking, and is confirmed by the User before the Application is sent;
- the final classification of the product and the form of conformity confirmation are determined by the accredited Contractor, and when goods are moved across the customs border — by the customs authority, under chapter 3 of the Customs Code of the EAEU;
- an advance ruling on the classification of goods under the HS code (TN VED) of the EAEU is issued by the authorized customs authority; the Platform does not issue such rulings and does not replace them;
- information about technical regulations and lists of products is given as of the time the System suggestion is created and may change after new versions come into force.
Responsibility for the use of the result
The use of AI selection does not release the User from the obligation to check the information in the final documents and to ensure that the product meets the requirements of technical regulation. The Operator is not responsible for a refusal of a Contractor or a customs authority to accept the suggested classification, for additional customs payments, for bringing the User to liability under articles 14.43–14.46.2 of the Code of Administrative Offences of the Russian Federation, or for other consequences of decisions that the User made on the basis of the System suggestion.
Automated processing does not lead to decisions that create legal consequences for the personal data subject without human participation: the result is confirmed by the User, and the decision to work on the Application is made by the Contractor.
Role of contractors
Contractors are certification bodies and testing laboratories that have a valid accreditation certificate; information about them is checked against the register of accredited persons of the Federal Accreditation Service, which is a public state information resource.
Contract model
- the contract for conformity assessment work is concluded directly between the User and the Contractor; the Operator is not a party to this contract;
- the Operator acts as an information intermediary and is not an agent, surety or guarantor of either party;
- the Contractor decides independently whether to accept the Application for work and may reject it;
- the periods, cost and procedure of the work are determined by the Contractor.
Status check
- when a Contractor is connected, the certificate number, the accreditation status and its scope are checked;
- the information is updated from the register data; if the accreditation certificate is suspended or terminated, the Contractor’s profile is hidden from the results;
- the Operator does not guarantee that the state register is updated continuously and is not responsible for the accuracy of the information in it;
- the User may, and can, check the status of the Contractor independently on the official website of Rosaccreditation before concluding the contract.
The conditions for connecting Contractors are described in the section “For contractors”.
Liability of the parties
Liability of the Operator
The Operator is responsible for the operation of the Platform and for the safety of the information given to it, within the limits of the protection measures taken. The Operator is not responsible for:
- decisions of the User made on the basis of the System suggestion;
- actions and inaction of Contractors, the quality and timing of the work they perform, and the content of the documents they issue;
- the accuracy of information provided by the User, and the consequences of its incompleteness;
- interruptions in the operation of the Platform caused by failures of equipment and communication networks, actions of providers, updates, and force majeure;
- lost profit, reputational harm and other indirect losses of the User.
The total amount of the Operator’s liability under the contract is limited to the sum that the User actually paid for the services of the Platform during the 6 months before the event that is the basis for the claim. If the services were provided free of charge, the Operator’s liability is limited to fixing defects of the Platform.
Liability of the User
The User is responsible for the accuracy of the information provided, for the lawfulness of the transfer of documents and of the personal data of third parties contained in them, and for compliance with the requirements of technical regulation when products are put into circulation. The parties are released from liability for failure to perform their obligations if it is caused by force majeure: natural disasters, military actions, acts of public authorities, mass failures of communication networks and power supply, and restrictions of access to the Internet. Claims and dispute resolution
Claim procedure
Before going to court, the parties must follow the pre-trial procedure. The claim is sent to the email address iigalochka@yandex.ru and by post to the address in the section “Company details”. It states the substance of the demand and its justification, and the calculation of the sum if the demand is for money. The period for review is 30 calendar days from the date of receipt, in accordance with part 5 of article 4 of the Arbitration Procedure Code of the Russian Federation.
Jurisdiction
Disputes that are not settled by the claim procedure are heard by the Arbitration Court of the Samara Region — at the location of the Operator. Disputes with individuals that are not related to business activity are heard by a court of general jurisdiction under the jurisdiction rules set by procedural law. This condition does not limit the consumer’s rights provided by Law of the Russian Federation No. 2300-1 of 07.02.1992.
Requests on personal data
Requests related to the processing of personal data are reviewed in the manner and within the periods stated in the section “Rights of the personal data subject”. You may also apply to Roskomnadzor, as the authorized body for the protection of the rights of personal data subjects.
Electronic document exchange
The parties recognize the legal force of messages and documents sent from the email addresses stated in the user account and in the section “Contacts”. Such messages are equal to paper documents signed by hand, unless the law expressly provides otherwise.
