How to determine the HS code (TN VED) and not make a mistake at customs
How the code is built, what affects classification, and what a mistake at import means.
The country of origin and the country of dispatch are different things, and the difference costs money: the duty rate, access to procurement and exposure to restrictive measures depend on it.
The country of origin of goods and the country from which they arrived are different things, and the difference costs money. The duty rate, the possibility to take part in procurement and exposure to restrictive measures depend on origin. It is confirmed by a separate document, which has nothing to do with conformity assessment, but is requested by the same people and at the same moment.
Goods can be produced in one country, shipped from a warehouse in a second one and cleared through customs in a third one. For customs, the first one matters. This is why an attempt to "reissue" a delivery through an intermediate country changes nothing: origin is determined by where the goods were produced or sufficiently processed, not by where the truck came from.
| Form | Purpose |
|---|---|
| ST-1 | Goods originating in CIS countries — for preferences in mutual trade |
| Form A | Preferential regime under the generalized system of preferences |
| General form | When preferences are not needed but origin must be confirmed: procurement, counterparty requirements, bank operations |
Other forms are used in trade with countries with which separate agreements are concluded. Which form is needed is determined not by the wish of the applicant but by where and for what purpose the goods are going — so the request "make us a certificate of origin" always starts with the question of what it is for.
There are two criteria, and they are applied one after the other.
Sufficient processing is confirmed in one of these ways: a change of the product code in the nomenclature at a certain number of digits, specific production operations, or the share of value added in the country of production. Which way applies to your goods depends on the rules in the specific agreement.
Certificates of origin are issued by chambers of commerce and industry. The applicant is the manufacturer or the exporter. The set usually includes an application, documents for the goods, information about production and, if the criterion of sufficient processing is used, a cost calculation with confirmation of the origin of raw materials and materials.
The most labor-intensive part is not the application but the evidence for the raw materials. If the supplier of components does not give documents on origin, there is nothing to confirm the criterion with, and no chamber can get around this.
Russian origin of products is confirmed for admission to procurement with preferences and for inclusion in industry registers. Here an ST-1 certificate or an expert examination act is not a formality but a condition for participation: without it the application simply does not pass the selection. For a manufacturer who is entering the corporate and government customer market, this work usually goes in parallel with conformity assessment and needs the same data about composition and production.
A certificate of origin can be verified: customs has the right to ask the issuing chamber to confirm authenticity and validity. If the check shows that the criterion was not met, the preference is cancelled — with additional duty and penalties for the whole period. So "drawing" origin for a reduced rate is not a saving but a delayed loss, and with interest.
A separate typical story is a mismatch between the certificate and the other documents: one name in the certificate, another in the declaration, a third in the HS code (TN VED). The check starts with comparison, and any mismatch is a reason for a request. If there are doubts in classification, it is more reliable to get a preliminary decision in advance.
Origin and rights ownership are different questions. Goods imported under parallel import have the same origin as goods bought from an official distributor: it is determined by the place of production. Neither the import mechanism nor the absence of the rights holder's consent affects it. But getting a certificate for such goods is harder — the evidence about production has to be collected without the help of the manufacturer.
