Certificate or declaration: how to understand what your product needs
How the forms of conformity confirmation differ, and who chooses the right one.

Parallel import removes the question of the rights holder's consent to import. It does not cancel the requirements of technical regulations: conformity documents are still needed.
Parallel import is often understood as a mode of “we import anything without papers”. In fact, it solves exactly one task: it removes the need to get the consent of the trademark rights holder. All the rest of the regulation stays in place.
In parallel import, the applicant is the importer itself — a Russian legal entity or an individual entrepreneur. This means that the responsibility for the accuracy of the data also lies with the importer, not with the foreign manufacturer.
| Situation | Solution |
|---|---|
| A one-time delivery of a small batch | A batch scheme: testing of samples from this batch |
| Regular deliveries of one model | A serial production scheme with the manufacturer's documents |
| A distributor's document exists | A written permission of the holder to use it |
| The product is outside the regulations | A refusal letter for platforms and counterparties |
How not to make a mistake with the code, on which both the list and the regulations depend — in the basic article on the HS code (TN VED).
| Requirement | Ordinary import | Parallel import |
|---|---|---|
| Consent of the rights holder | required | not required |
| Conformity document | required | required |
| Labelling with the EAC mark | required | required |
| Chestny ZNAK (national labelling system) codes | by the list | by the list |
| Documents in Russian | required | required |
Parallel import is allowed not “in general”, but selectively: there is a list of goods to which some provisions on the protection of exclusive rights do not apply. It is made by HS codes (TN VED) and brands, and this is an important detail — getting into the list is determined by the combination, not by the name of the brand alone.
The list is reviewed: items are added and excluded. It must be checked on the date of the deal, not from memory of last year's delivery — the brand may have left it.
The platforms treat parallel import with caution, because this is where the complaints of rights holders arrive. In practice this shows up as additional requests.
| What is requested | Why |
|---|---|
| Conformity documents for your batch | Confirmation that the product was lawfully put into circulation |
| Customs declaration | Confirmation of the legal import of this particular batch |
| Invoice and contract | The chain from the seller abroad to you |
| Confirmation that the brand is in the list | Justification of the lawfulness of import without the consent of the rights holder |
Advice that saves weeks: collect this set right at the time of import, and not when the card is already blocked. Restoring documents afterwards, especially invoices from a foreign supplier, takes a long time.
This is the side of the question that sellers think of last and buyers think of first. With parallel import, the brand's official service is not obliged to service the product: it has no contract with you, and the product did not pass through the official channel.
The seller's duties follow from this.
Separately, about software and subscriptions: equipment tied to regional services may partly not work. This is not a defect in the legal sense, but it is a reason for returns and claims if the buyer was not warned.
This situation is frequent: the product was bought and brought in, and the questions of conformity confirmation were dealt with later. The recovery order depends on what exactly is missing.
What is almost impossible to fix afterwards is the absence of the product in the list. If the brand is not included in it, conformity documents do not save the situation: the claim will not be about safety, but about exclusive rights.
