Liability for violating technical regulations: what the business risks
A missing document is not the only risk. Punishment also follows for false data and for selling goods that are formally covered by a document but in fact do not conform to it.

Checks in the field of technical regulation rarely come unexpectedly: more often the reason is a buyer's complaint, an appeal from a competitor or mismatches found during customs control. After that, everything depends on what exactly is found.
Three typical situations
What exactly leads to liability
01No documentThe products were put into circulation without mandatory assessment
02A document exists, the goods do not conformThe requirements of the regulation are in fact violated
03The document is falseRegistration on the basis of false data
The third case is the most unpleasant: the document is cancelled, and all the products are considered released without conformity assessment.
What is taken into account when the punishment is set
Whether harm was caused. Harm to life, health or property sharply increases the size of the sanction.
Repeat violation. A repeat violation is treated more strictly and more often comes with confiscation.
Product category. Children's goods, food and protective equipment are an area of increased attention.
Role of the person. The manufacturer, the importer and the seller are each responsible for their part of the chain.
About confiscation Confiscation is applied as an additional measure and concerns the objects of the offence — that is, the batch itself. For an importer this means losing not only the fine but also the value of the goods together with logistics.
Where it most often breaks
Risky practices
A document bought "turnkey" without real tests
A test report issued by a laboratory with a suspended accreditation certificate
One document extended to the whole product line without checking the modifications
Marking applied before the document is issued
The product data in the document do not match the actual data
What reduces the risk
Tests in a laboratory with a checked scope of accreditation
Keeping test reports and evidence for the whole validity period of the document
A separate check of each modification and each raw material supplier
Regular checks of the document status in the register
Checking that listings and labels match the documents
What to do if an inspection arrives
Collect the set: the conformity document, the test reports, the operating documents
Check the status of the document and of the laboratory's accreditation certificate on the date of the inspection
Record which batch and which period is being checked
Do not sign documents with wording that you do not understand
If a non-conformity is found — stop sales until it is clarified
Prevention costs less
Most of the situations in this article arise not from bad intent but from saving on one step: they did not check the laboratory, did not compare the name, did not issue a document under the second regulation. The cost of these steps is not comparable to the cost of a detained batch.

What is at stake
Consequences that a business counts
Batchmay be confiscated as an object of the offenceadditional measure
Downtimestorage in a temporary storage warehouse is paid per daywhile the proceedings continue
Repeata repeat violation is treated more strictly than the firstand more often with confiscation
The cost of prevention — tests and a check of the contractor — is an order of magnitude lower than any of these items.
Who exactly is held liable
Different persons can be liable for the same violation, and the amounts differ by an order of magnitude. This is the first thing to understand when assessing the risk.
Who
Features
Legal entity
The largest amounts; a fine on the organization does not exclude punishment of the director
Official
The director or the responsible employee — is liable for organizing the process
Individual entrepreneur
For a number of offences is equated to an official, but not always
Manufacturer
Is liable for the conformity of the products and the truthfulness of the documents
Importer
In its duties is equated to the manufacturer
Seller
Is liable for selling products without documents and with violations of marking
A practical conclusion for sellers: "we only resell" does not remove liability. Selling products without proof of conformity is a separate type of offence, and the seller is liable.
What happens to the products themselves
The fine often turns out not to be the main loss. At the same time the fate of the goods is decided, and the options here are worse than money.
Withdrawal from circulation. The products are taken off sale, including the stock held by counterparties.
Confiscation. For a number of offences it is applied as an additional punishment — the goods are taken without compensation.
Suspension of the document. The declaration or certificate stops being valid, and all the products released under it are left without confirmation.
Product recall. If there is a threat to life and health, the manufacturer must organize a recall at its own cost, including informing the buyers.
A recall is the most expensive: it costs not so much logistics as reputation and relations with marketplaces. What to do when a document is suspended, we explained separately.
A repeat violation counts A repeated similar violation is considered an aggravating circumstance and increases the punishment. So the first claim is not only about a specific product: it sets the bar for all the following ones.
When the case stops being administrative
The line is drawn by the consequences and the scale. Administrative liability is about breaking the rules. As soon as there is harm to health or a large turnover, the classification changes.
Causing harm to life and health as a result of non-conforming products
Production and sale of products that do not meet safety requirements
A large turnover of unmarked products from the groups subject to mandatory marking
Use of knowingly forged conformity documents
The last item deserves attention: buying a "document in an hour" without tests is not saving on procedure but using a document for the contents of which the applicant is responsible. In this case liability arises for the person whose name is in the declaration, not for the person who printed it.
What really softens the outcome
When a violation is found, you cannot avoid the consequences entirely, but you can influence the result.
Voluntary correction before the decision is made. You issued the missing documents, withdrew the products, corrected the marking — this is recorded.
Helping the inspection. Quick submission of documents and explanations works better than delay.
No harm. A formal violation with no victims is assessed differently from a violation with consequences.
Insignificance. In some cases a warning is enough, but you cannot rely on this as a strategy.
A control system in place. Internal procedures for checking documents show that the violation is a single case, not a systemic one.
The last one is the only item that works in advance, not afterwards. A register of goods with documents and dates, a person responsible for checking, a procedure for accepting goods from suppliers: all this costs less than one proceeding. The typical mismatches that such a check catches are collected in a separate article.
